1. General Rules and Regulations

A. These bylaws are approved by THE SELLER and apply to any new house sold and are non-negotiable.  
B. Any changes to these bylaws must be approved according to the wishes of all property owners in the community.  
C. Changes shall be made in accordance with Chapter 18 of this document.  
D. By accepting these bylaws, each property owner agrees to comply with them without exception.  
E. Any violation may be reported to the courts of the Republic of Panama and local authorities as applicable.

Question 2

2. About the Lots

Accepted Answer

A. Each lot is segregated from the main estate by approx. 2000 m², with variations between 1800 m² and 2000 m² depending on geography, drainage, wetlands, access areas, etc.  
B. Lots include land geography up to access roads and adjacent lots.  
C. Easements: 3 meters from neighboring lots, 3 meters from roads and common areas.  
D. Lots are titled and registered under the new owner's name by the closing date.

3. Construction Rules

Accepted Answer

A. All materials and structures must comply with Panama's approved building codes.  
B. Permits are obtained by THE SELLER.  
C. Easements in Section 2 must be strictly followed.  
D. Max height: one floor + one story, totaling 7 meters.  
E. Built area may not exceed 20% of lot surface.  
F. This rule applies permanently and affects future developments.  
G. All builders must be approved by THE COMMUNITY.  
H. Wooden structures must be treated externally with two layers of high-density pentadril solution before sealing.  
I. A rainwater collection system of at least 2000 liters is required.  
J. Overflow must be drained to the nearest street drain, never onto neighboring lots.  
K. All buildings must include seismic beams suitable to the size and weight of the structure.  
L. All units must have R23 insulation value regardless of material.  
M. Pools must be built with structural beams, steel bars, and fiber-reinforced concrete.  
N. Pool overflow must go to the nearest street drain, never to a neighbor’s lot.

Question 4

4. Treatment Plants

Accepted Answer

All houses will be equipped with AGUST treatment plants, replacing septic tanks and drainage systems, adjusted to each house's occupancy.

5. Roads

Accepted Answer

A. Roads are categorized as Main and Secondary.
B. Main roads provide access to all properties and may be used by cars, trucks, and utility vehicles.
C. Secondary roads are for bikes, golf carts, or small utility vehicles, accessing specific community areas.
D. All road maintenance is the responsibility of Burn Brae Plantation and funded by CID fees.
E. Main roads: 9m wide with 1.5m public easement on each side.
F. Secondary roads: 3m wide with 1m public easement on each side.
G. Roads are gravel with correct slope for drainage.
H. Roads will be maintained as necessary for safety.
I. Roads will be lit; cost covered by CID fees.

Question 6

6. Common Areas

Accepted Answer

A. Common areas include parks, green zones, gyms, BBQ zones, and playgrounds, available to all residents.
B. Maintenance is the responsibility of Burn Brae Plantation, funded by CID fees.
C. Use must not disturb community members.
D. Use is exclusive to residents and their guests; outsiders are not allowed.
E. A dock usage regulation will be added once that area is completed.

Question 7

7. Commercial and Rental Use

Accepted Answer

A. Housing units may have commercial use according to these statutes.
B. Short-term rentals are allowed with a minimum stay of 3 nights.
C. No food or beverage operations are allowed.
D. No vehicle rental operations are allowed.
E. No operations that harm the environment are allowed.
F. No animal shelters or veterinary clinics allowed.
G. No livestock businesses allowed.
H. No hostels or hotels allowed.
I. Bars, clubs, nightclubs, restaurants, and cantinas are not allowed.

Question 8

8. Private Use

Accepted Answer

A. Private use of housing may be delegated if the new user agrees to these statutes.
B. Violations will be attributed to the property owner, not the user.

Question 9

9. Noise Regulations

Accepted Answer

A. Everyone’s right to peace and quiet must be respected.
B. Loud construction equipment may be used only from 8 a.m. to 5 p.m., Monday to Friday.
C. If concrete pouring exceeds this schedule, all residents must be notified 2 days in advance.
D. Such work must only occur on weekdays.
E. No loud construction work on Sundays.
F. All vehicles must follow Panamanian noise regulations.
G. Drivers of loud vehicles (ATVs, golf carts, motorcycles) must keep low RPMs to avoid disturbing the community.

Question 10

10. Street Use

Accepted Answer

A. All community members and their guests may use the community roads.
B. Guests’ behavior on the roads is the responsibility of the inviting member.
C. The speed limit within the gates is 20 km/h.
D. Delivery trucks must respect community rules, and property owners must inform them of the correct road use and limitations.
E. Delivery trucks are allowed in the community from Monday to Saturday.

Question 11

11. Waste Regulations

Accepted Answer

A. All solid waste must be stored in a closed space at the entrance of each lot.
B. Garbage trucks are allowed in the community on Mondays, Wednesdays, and Fridays.
C. For construction waste, each owner or builder must organize special trucks at least once a week.
D. During construction, it is strongly recommended that a container be assigned to keep materials organized and prevent spillage.
E. Burning of garbage, leaves, or any material is strictly prohibited in the community.
F. All solid waste must be prepared in jumbo bags to facilitate collection.
G. Household waste costs are covered by CID fees.
H. Construction waste costs are the responsibility of the property owner or builder.

Question 12

12. Pet and Animal Regulations

Accepted Answer

A. Pet responsibility lies solely with the owner.
B. Pets may walk within the community, but owners must pick up their waste in plastic bags.
C. Pets must be trained not to interact with or scare local wildlife such as monkeys, iguanas, sloths, and others.

Question 13

13. Authorities Accessing the Community

Accepted Answer

A. All authorities may access the community for legal reasons.
B. The community cannot deny access to any authority of the Republic of Panama.
C. Regulatory construction authorities will have access codes and may inspect at any time.

Question 14

14. About Basic Services

Accepted Answer

A. Burn Brae Plantation provides electricity to each lot, billed quarterly based on meter readings.
C. Water connection and cost are the responsibility of each owner.
D. Internet connection must be handled individually by each owner.

Question 15

15. Security and Access

Accepted Answer

A. Entry to the private community is via intercom call.
B. To add your number to the gatekeeper system, you must request it from Burn Brae Plantation management.
C. Security cameras operate in all common areas and are monitored by Burn Brae Plantation.

Question 16

16. Fire Safety

Accepted Answer

A. All construction plans must be approved and stamped by the Republic of Panama Fire Department before building.
B. Each home must have 2 ABC-rated fire extinguishers with a minimum of 30 pounds each.
C. All gas tanks or combustible materials must be stored according to Panamanian fire safety regulations.
D. The fire department must have access to water reserves on all properties in case of fire.
E. It is strictly prohibited to store or ignite fire-hazard materials such as fireworks, firecrackers, ammunition, and others on any property in Burn Brae Plantation.

Question 17

17. Pest Control

Accepted Answer

A. All common areas and roads will undergo mandatory monthly fumigation to control mosquito populations.
B. Each property must undergo deep exterior fumigation quarterly.
C. Interior fumigation is at the owner's discretion.
D. Properties must avoid leaving open containers outdoors that can collect rainwater.
E. All holes or cavities must be drained properly, as water accumulation can lead to dengue mosquito infestations.

Question 18

18. Application and Adaptation of the Regulations

Accepted Answer

A. These statutes are mandatory for all community members.
B. Suggestions and feedback on the rules are welcome and encouraged.
C. Any changes or adaptations to these statutes will be presented at the beginning of each year based on submitted suggestions.

Question 19

19. CID (Common Interest Association) Fees, Budget and Penalties

Accepted Answer

A. CID fees are calculated based on the square meters of the lot and construction.
B. The CID budget is presented annually in the first quarter.
C. CID fees cover the following expenses: common energy use, landscaping and maintenance of common areas, road maintenance, gate maintenance, security cameras, fumigation and pest control, and garbage for each property (excluding construction waste).
D. CID land fee for 2024: $0.05 per square meter/month.
E. CID construction fee for 2024: $0.10 per square meter/month, with a minimum of $150/month.
F. Land fees begin upon the initial payment.
G. Construction fees begin the month building starts.
H. CID fees are billed quarterly by Burn Brae Plantation.
I. Delays over 30 days incur 15% monthly interest until payments are up to date.
